Feds Say Murtha Immune From Pa. Haditha Suit, Too – Defamation of our troops by democrats is apparently cool

A Justice Department attorney said U.S. Rep. John Murtha, Democrat, should be immune from a defamation lawsuit filed by a former Marine from western Pennsylvania according to WTAE:

Essentially, Murtha’s attorney said the lawsuit filed in September by Justin Sharratt, of Canonsburg, should be dismissed for the same reasons that a federal appeals court struck down a similar suit by Staff Sgt. Frank Wuterich, of Meriden, Conn., last week.

The court ruled that Murtha couldn’t be sued because he was acting within the scope of his employment when he accused Wuterich’s squad of killing innocent civilians “in cold blood” in Haditha, Iraq in 2005.

Sharratt has been cleared of wrongdoing. Wuterich remains charged by a military court but says he’s innocent.

Sharratt said Murtha’s comments on TV news shows go beyond his duties as a congressman.

It is the first time in memory that a sitting national leader of the Republican Party has faced a public challenge over his ideological leadership by conservative members of his own national committee.

The Case for a Federalism Amendment

In response to an unprecedented expansion of the federal government and its power in just the first 90 days of the Hussein Obama administration, citizens have held hundreds of “tea party” rallies around the country (most of which either ignored by the media, or mocked). Also several states are considering “sovereignty resolutions” invoking the Constitution’s Ninth and Tenth Amendments. For example, according to the Wall Street Journal: Michigan’s proposal urges “the federal government to halt its practice of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States.” More from the WSJ:

While well-intentioned, such symbolic resolutions are not likely to have the slightest impact on the federal courts, which long ago adopted a virtually unlimited construction of Congressional power. But state legislatures have a real power under the Constitution by which to resist the growth of federal power: They can petition Congress for a convention to propose amendments to the Constitution.

Article V provides that, “on the application of the legislatures of two thirds of the several states,” Congress “shall call a convention for proposing amendments.” Before becoming law, any amendments produced by such a convention would then need to be ratified by three-quarters of the states.

An amendments convention is feared because its scope cannot be limited in advance. The convention convened by Congress to propose amendments to the Articles of Confederation produced instead the entirely different Constitution under which we now live. Yet it is precisely the fear of a runaway convention that states can exploit to bring Congress to heel.

One specific complaint about MSNBC concerned Keith Olbermann’s interview of actress Janeane Garofalo, who likened conservatives to racists and spoke of “the limbic brain inside a right-winger.”

“They were upset that Olbermann didn’t bother to challenge her,” one GE shareholder said…

“My biggest surprise was the open hostility to MSNBC,” another shareholder said. “It was noticeable and loud. I don’t remember any of this going on last year.”

Taliban situtation getting worse in Pakistan

Or is it Polk-ee-Stan. The Taliban in Pakistan have issued a direct challenge to the legitimacy of the Pakistani government, by declaring the country’s entire legal system “un-Islamic.” From Communist News Network:

“Let the judges and the lawyers go to Islamic university,” said Muslim Khan, a Taliban spokesman in Pakistan’s Swat Valley. “(After) they learn Islamic rules, Islamic regulation, they can continue to work.”

In a telephone interview Tuesday with CNN, Khan demanded the imposition of Islamic sharia law all across the country. He also called for the creation of jaziya, an Islamic tax, to be levied on all non-Muslims in Pakistan. And Khan denounced any Pakistanis who disagreed with his interpretation of Islam, calling them “non-Muslims.”

The Taliban militant echoed statements made by Sufi Muhammed, an Islamist fundamentalist leader who helped broker a peace deal between the Pakistani government and the Taliban in Swat Valley.

Last week, the deal led to the implementation of sharia law in Swat, an alpine region that was once one of Pakistan’s most popular destinations for foreign tourists.

David Kellermann – CFO of Freddie Mac kills himself

David Kellermann, acting chief financial officer of Freddie Mac, was found dead in his Hunter Mill Estates home Wednesday morning in what police say was an apparent suicide.According to WTOP:

Fairfax County Police spokeswoman Mary Anne Jennings tells WTOP police responded to the Kellermann home after family members dialed 911 at 4:48 a.m.

Sources tell WTOP Kellermann hanged himself.

“We were called from inside the house to come investigate an apparent suicide,” Jennings says.

“We’re not going to give you details of the condition of the body, except to say it was an apparent suicide.”

CNN security guard assaults a Preacher in Atlanta!

A pastor said a CNN security guard assaulted, falsely imprisoned, and harassed him all because of his religious expression. According to WSBTV (Channel 2 in Atlanta):

Dick Christensen has filed a civil lawsuit against the guard, CNN, and Turner Broadcasting. Christensen said he believes the sidewalk is public property. If it is, Christensen said Turner Security shouldn’t have slammed him to the ground and detained him for holding a religious banner there.His video camera caught the incident on tape.On video, you can hear the security guard ask Christensen, “You know where the property line begins?” Christensen responded, “I’ve been out here preaching.” The security guard then said, “I didn’t ask you what you were doing. What I’m asking is do you know where the property line begins?”
