It’s not only the Chicago way, it’s the Democrat way, period. According to Fox News, Four Democrat officials and political operatives have pleaded guilty to felony voter fraud in an alleged scheme to steal a New York election. Troy Democratic City Clerk William McInerney, Democratic Councilman John Brown, and Democratic political operatives Anthony Renna and Anthony DeFiglio have entered guilty pleas in the case in which they “allegedly” tried to manipulate the electoral system and throw an election the Democrat. This includes the “alleged” forging of signatures of unsuspecting voters that are then cast as real votes. Oh, the signatures were “allegedly” forged on absentee ballots in the 2009 Working Families Party primary. This is/was the political party that was associated with Obama’s group ACORN.

“The phrase they use is: ‘making sure they vote the right way,’” said a source close to the case, which is unfolding in Troy, N.Y. “It is not a Democratic or Republican thing. … It is criminal.”
Former Troy Democratic City Clerk William McInerney, Democratic Councilman John Brown, and Democratic political operatives Anthony Renna and Anthony DeFiglio have entered guilty pleas in the case, in which numerous signatures were allegedly forged on absentee ballots in the 2009 Working Families Party primary, the political party that was associated with the now-defunct community group, ACORN.

AHCOA or is known as the Association of Community Organizations for Reform Now. Before James O’Keefe and Hanna Giles exposed Acorn for the fraud that they were and Acorn disbanded (and split into over hundred different pieces) this group was known as ACORN Housing. According to the Daily Caller, not only Obama but the Government Accountability Office incorrectly argued that a specific organization wasn’t ACORN-affiliated. Where i come from, this is lying. Not “incorrectly argued.” So much for the GAO.

The Obama administration has awarded more than $700,000 in taxpayer funds to AHCOA despite a 2010 law stipulating that no taxpayer funds could be awarded to ACORN “or any of its affiliates, subsidiaries, or allied organizations.”

The previously confidential internal audit report, from NeighborWorks America, shows that contrary to what the GAO and the Obama administration contend, AHCOA is far too close to ACORN to receive taxpayer funding. In fact, NeighborWorks America — a nonprofit group that doles out taxpayer funds — decided against sending cash to AHCOA because of the internal audit report it conducted.

“Although AHC and ACORN might be incorporated as separate entities in form and structure, the financial transactions noted below evidence extensive relationships between both organizations that may undermine claims of an ‘arm’s length relationship’ between them,” the NeighborWorks America auditors wrote.

Even so, the GAO issued a September 2010 letter giving the Obama administration cover to legally provide AHCOA with taxpayer cash.

ACORN is behind the scenes organizing “guerrilla” protest events and hiring door-to-door canvassers to collect money under the banner of various causes while spending it on protest-related activities.

The former director of New York ACORN, Jon Kest, and his top aides are now busy working at protest events for New York Communities for Change (NYCC). That organization was created in late 2009 when some ACORN offices disbanded and reorganized under new names after undercover video exposes prompted Congress to cut off federal funds.

Sources said NYCC has hired about 100 former ACORN-affiliated staff members from other cities – paying some of them $100 a day – to attend and support Occupy Wall Street. Dozens of New York homeless people recruited from shelters are also being paid to support the protests, at the rate of $10 an hour, the sources said.

According to the SF Chronicle, Federal prosecutors filed reduced charges Friday against conservative activist James O’Keefe and three others who were accused of trying to tamper with the phones in Sen. Mary Landrieu’s New Orleans office. The new charges are contained in a bill of information, which can only be filed with a defendant’s consent and typically signals a plea deal. The new filing charges videographer the four with entering a federal building under false pretenses, a misdemeanor. They had been arrested Jan. 25 on felony charges.

O’Keefe, a videographer famous for wearing a pimp costume in a stunt that embarrassed the ACORN community organizing group, has said the group was trying to investigate complaints that constituents calling Landrieu’s office couldn’t get through to criticize her support of a health care reform bill.

J. Garrison Jordan, a lawyer for another defendant, Robert Flanagan, said his client has “an agreement worked out with the government” but wouldn’t elaborate or confirm that the others also have reached a deal with prosecutors.

“I think it’s a fair resolution to the charges, and I’m happy with the agreement we’ve worked out,” he said.

Lawyers for the other three defendants didn’t immediately return calls. A spokesman for Landrieu said he couldn’t immediately comment, and a spokeswoman for the U.S. Attorney’s office in New Orleans would not comment on a possible plea deal.

Federal authorities initially accused the four of trying to tamper with Landrieu’s phones, but the new filing merely says they planned to pretend to test the phone system.

The FBI said O’Keefe, 25, of New Jersey, used his cell phone to try to capture video of two other men who posed as telephone repairmen and asked to see the phones at Landrieu’s office. The fourth allegedly waited outside in a car with a listening device.

The two suspects who posed as repairmen — Joseph Basel and Robert Flanagan, both 24 — wore white hard hats, tool belts and fluorescent vests. One of them had a camera hidden in his helmet.

Flanagan, of New Orleans, is the son of the acting U.S. Attorney based in Shreveport. Basel, of Minnesota, and Stan Dai, 24, of the Washington, D.C. area, also were arrested.

The four suspects originally were charged with entering federal property under false pretenses for the purpose of committing a felony, which carries a penalty of up to 10 years in prison and a $250,000 fine.

The new charges carry maximum sentences of six months in prison and a $5,000 fine. A date for their next court appearance has not been set.

In an interview on Sean Hannity’s Fox News talk show after his arrest, O’Keefe said he didn’t think the group broke any laws and insisted he was using techniques commonly employed by investigative journalists.

Undercover videos are a staple of O’Keefe’s work, most famously when he used a hidden camera as he brought a young woman posing as a prostitute into ACORN offices.

ACORN, the Association of Community Organizers for Reform Now, announced earlier this week that it is folding due to falling revenues that the group blames on partisan attacks.

According to Fox News, the corrupt, Obama backed community activist group ACORN announced Monday it is folding amid falling revenues — six months after video footage emerged showing some of its workers giving tax tips to conservative activists posing as a pimp and prostitute (James O’Keefe and Hannah Giles.)

“It’s really declining revenue in the face of a series of attacks from partisan operatives and right-wing activist that have taken away our ability to raise the resources we need,” ACORN spokesman Kevin Whelan said.

Several of its largest affiliates, including ACORN New York and ACORN California, broke away this year and changed their names in a bid to ditch the tarnished image of their parent organization and restore revenue that ran dry in the wake of the video scandal.

ACORN’s financial situation and reputation went into free fall within days of the videos’ release in September. Congress reacted by yanking ACORN’s federal funding, private donors held back cash and scores of ACORN offices closed.

Earlier this month, a U.S. judge reiterated an earlier ruling that the federal law blacklisting ACORN and groups allied with it was unconstitutional because it singled them out. But that didn’t mean any money would be automatically be restored.

Bertha Lewis, the CEO of ACORN, which stands for the Association of Community Organizations for Reform Now, alluded to financial hardships in a weekend statement as the group’s board prepared to deliberate by phone.

“ACORN has faced a series of well-orchestrated, relentless, well-funded right wing attacks that are unprecedented since the McCarthy era,” she said. “The videos were a manufactured, sensational story that led to rush to judgment and an unconstitutional act by Congress.”

ACORN’s board decided to close remaining state affiliates and field offices by April 1 because of falling revenues, with some national operations will continue operating for at least several weeks before shutting for good, Whelan said Monday.

For years, ACORN could draw on 400,000 members to lobby for liberal causes, such as raising the minimum wage or adopting universal health care. ACORN was arguably most successful at registering hundreds of thousands of low-income voters, though that mission was dogged by fraud allegations, including that some workers submitted forms signed by ‘Mickey Mouse’ or other cartoon characters.

Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced that it has obtained documents from the Federal Bureau of Investigation (FBI) detailing federal investigations into the alleged corrupt activities of Association of Community Organizations for Reform Now (ACORN)! The documents reference serious allegations of corruption and voter registration fraud by ACORN as well as the Obama administration’s decision to shut down a criminal investigation without filing criminal charges.

The documents include background information on two specific complaints filed in October 2008 by Lucy Corelli and Joseph Borges, Republican Registrars of Voters in Stamford and Bridgeport, Connecticut, respectively, during the 2008 election season.

According to Corelli, on August 1, 2008, her office received 1,200 ACORN voter registration cards from the Secretary of State’s office. Over 300 of these cards were rejected because of “duplicates, underage, illegible and invalid addresses,” which “put a tremendous strain on our office staff and caused endless work hours at taxpayers’ expense.” Corelli claimed the total cost of the extra work caused by ACORN corruption was $20,000. Likewise, Borges contended that: “The organization ACORN during the summer of 2008 conducted a registration drive which has produced over 100 rejections due to incomplete forms and individuals who are not citizens…” Among the examples cited by Borges was a seven-year old child who was registered to vote by ACORN through the use of a forged signature and a fake birth certificate claiming she was 27-years old.

The FBI and Department of Justice opened an investigation. However, the Obama Justice Department, while noting that ACORN had engaged in “questionable hiring and training practices,” closed down the investigation in March 2009, claiming ACORN broke no laws.

By contrast, the documents also include records related to a federal investigation of ACORN corruption in St. Louis, Missouri, involving 1,492 allegedly fraudulent voter registration cards submitted by Project Vote, a liberal non-profit organization affiliated with ACORN on voter registration drives, during the 2006 election season. Assistant United States Attorney Hal Goldsmith initiated the investigation with “concurrence” from the Department of Justice and the participation of the FBI. According to a Justice Department memo, Goldsmith “advised he would prosecute any individual responsible for submitting fraudulent voter registration cards.” Goldsmith identified the statute for prosecution: Title 42, USC 1973 (gg), which provides for criminal penalties for fraudulent voter registrations. In April 2008, eight former ACORN employees from the St. Louis office pled guilty to voter registration fraud.

Other documents show that the Bush Justice Department failed to prosecute ACORN voter registration fraud of non-citizens in Phoenix, Arizona in 2007 because the allegations that led to the opening of the investigation were “unverifiable.” Notably, the FBI document detailing this questionable decision reveals that a “draft Intelligence Bulletin…concludes that ACORN’s employment practices perpetuate fraudulent voter registration.”

The ACORN documents uncovered by Judicial Watch include internal FBI memoranda, signed affidavits, subpoenas, fraudulent voter registration cards, and publications describing ACORN’s policies and practices. The documents also include details regarding numerous allegations of corruption extending beyond voter registration fraud, to include attempts by ACORN employees to coerce workers to participate in campaign activities on behalf of Democratic candidates.

“These documents reflect systematic voter registration fraud by ACORN,” said Judicial Watch President Tom Fitton. “It is a scandal that there has been no comprehensive criminal investigation and prosecution by the Justice Department into this evident criminal conduct. Given President Obama’s close connections to ACORN, including his campaign’s hiring of the ACORN’s Project Vote organization, it seems rather obvious why Attorney General Holder has failed to seriously investigate these and other alleged ACORN criminal activities.”

It was with great fanfare that ACORN, along with two recently-fired employees of its Baltimore office, sued last September over thesurreptitious taping of the employees advising O’Keefe and Giles on running a prostitution business out of a house. ACORN’s general counsel, Arthur Schwartz, told the Washington Post at the time that the defendants, young filmmakers O’Keefe and Giles, plus Andrew Breitbart’s Breitbart.com LLC, which disseminated the videos, had committed “clear violations of Maryland law” against audio recording without consent from all parties. But ACORN appears to have lost interest in the case since filing it, confirming my suspicion that it was little more than a press release on pleading paper.

Under Maryland Rule 2-507(b), “An action against any defendant who has not been served or over whom the court has not otherwise acquired jurisdiction is subject to dismissal as to that defendant at the expiration of 120 days from the issuance of original process directed to that defendant.” That’s exactly what the court did March 4, with no apparent notice from the media that covered the filing of the lawsuit. The court’s dismissal was without prejudice, meaning that the plaintiffs could theoretically re-file. But, as I argued shortly after it was filed, the lawsuit has substantive flaws that go well beyond the plaintiffs’ apparent lack of interest in pursuing it.

Upon reading this, my blood boiled. It seems that not only are all the outrageous earmarks in Obama’s fiscal 2011 budget, but ACORN, the embezzlement-prone, voter-registration-fraud-plagued, child prostitution promoting, leftist community organizing group, is slated to receive nearly $4 billion from a taxpayer-funded slush fund!

The money will come from the Community Development Block Grant, one of the Department of Housing and Urban Development’s longest-running programs. The HUD Web site cryptically defines the grant’s purpose as providing “communities with resources to address a wide range of unique community development needs,” not a reassuring description given the group’s recent past history of aiding the community through gratuitous missappropriation of funds.

Has Congress already forgotten the Sept. 2009 ban it passed on ACORN and ACORN-afiliate funding? Or the video that led to the ban, footage showing ACORN employees urging individuals they thought were a prostitute and her pimp to set up a brothel and advising the pair on evading taxpaying? It would have had a hard time doing so, cosidering that ACORN is currently suing the federal government for the attempted ban.

Though the largely Democratic House Appropriations Committee voted against the block last December, it is a Bill Clinton-appointee, U.S. District Court Judge Nina Gershon, who has truly aided the corrupt ACORN cause. Also in December, Gershon issued a federal injunction against the Congressional funding ban, crying that it ran afoul of the Constitution because under the ban, ACORN was “singled out by Congress for punishment that directly and immediately affects their ability to continue to obtain federal funding, in the absence of any judicial, or even administrative, process adjudicating guilt.”

In essence, Gershon has said ACORN can’t be punished now because the Obama administration failed to punish it earlier–through a long-overdue, much-needed criminal investigation into the group. But this is absurd, because ACORN’s not receiving such funding does not constitute its being deprived of a right. The funding is a gift, and Congress has the right to cancel contracts whenever it feels like it.

Just ask Blackwater, a company we are wondering whether Gershon would so heroically rush to defend were it to make the same move ACORN is now making.

Also arrested were Joseph Basel, Stan Dai and Robert Flanagan, all 24. Flanagan is the son of William Flanagan, who is the acting U.S. Attorney for the Western District of Louisiana, the office confirmed. All four were charged with entering federal property under false pretenses with the intent of committing a felony.

According to the FBI affidavit, Flanagan and Basel entered the federal building at 500 Poydras Street about 11 a.m. Monday, dressed as telephone company employees, wearing jeans, fluorescent green vests, tool belts, and hard hats. When they arrived at Landrieu’s 10th floor office, O’Keefe was already in the office and had told a staffer he was waiting for someone to arrive.

When Flanagan and Basel entered the office, they told the staffer they were there to fix phone problems. At that time, the staffer, referred to only as Witness 1 in the affadavit, observed O’Keefe positioning his cell phone in his hand to videotape the operation. O’Keefe later admitted to agents that he recorded the event.

After being asked, the staffer gave Basel access to the main phone at the reception desk. The staffer told investigators that Basel manipulated the handset. He also tried to call the main office phone using his cell phone, and said the main line wasn’t working. Flanagan did the same.

They then told the staffer they needed to perform repair work on the main phone system and asked where the telephone closet was located. The staffer showed the men to the main General Services Administration office on the 10th floor, and both went in. There, a GSA employee asked for the men’s credentials, after which they stated they left them in their vehicle.

The U.S. Marshal’s Service apprehended all four men shortly thereafter.

On December 9, Burris, an Illinois Democrat, pledged that he would filibuster a health care bill without a public option. “If we have to get 60 and it comes back and it does not have a public option in it, I will not vote for it,” he said. Then early last week he said he could vote for the bill if there were changes made to achieve the goals of the public option: “until this bill addresses cost, competition, and accountability in a meaningful way—it will not win [my vote].”

Asked last night before the Senate voted why he was planning to support a bill without a public option, Burris said: “We have a great bill–the best we could get. And it also covers most of our concerns: competition, cost, and accountability.” But had anything specifically changed in the text of the bill that helped him change his mind? Burris told THE WEEKLY STANDARD: “It was the disparity provision that was put in, which we had something to do with, in terms of making sure that diabetes and the other diseases that are affecting minorities are really studied by HHS in all of these pilot programs.”

The provision he cites, found on pages 240 through 248 of the manager’s amendment, requires that six different agencies each establish an “Office of Minority Health.” The agencies are the “Centers for Disease Control and Prevention, the Health Resources and Services Administration, the Substance Abuse and Mental Health Services Administration, the Agency for Healthcare Research and Quality, the Food and Drug Administration, and the Centers for Medicare & Medicaid Services.”

According to page 241 of the amendment:

In carrying out this subsection, the Secretary, acting through the Deputy Assistant Secretary, shall award grants, contracts, enter into memoranda of understanding, cooperative, interagency, intra-agency and other agreements with public and nonprofit private entities, agencies, as well as Departmental and Cabinet agencies and organizations, and with organizations that are indigenous human resource providers in communities of color to assure improved health status of racial and ethnic minorities, and shall develop measures to evaluate the effectiveness of activities aimed at reducing health disparities and supporting the local community. Such measures shall evaluate community outreach activities, language services, workforce cultural competence, and other areas as determined by the Secretary.’’

This should apply to any pimping, ho’in and child prostituion scheme that liberals set up before the videos came out from James O’Keefe and Hannah Giles. The Holder’s department’s conclusion which has been laid out in a recently disclosed five-page memorandum also adds a new wrinkle to a sharp political debate over the antipoverty group’s activities and recent efforts to distance the government from it according to the New York Times.

The deputy director of national operations for Acorn, Brian Kettenring, praised Mr. Barron’s decision.

“We are pleased that commitments will be honored relative to Acorn’s work to help keep America’s working families facing foreclosure in their homes,” he said.

Mr. Barron said he had based his conclusion on the statute’s phrase “provided to.” This phrase, he said, has no clearly defined meaning in the realm of government spending — unlike such words as “obligate” and “expend.”

Citing dictionary and thesaurus entries, he said “provided to” could be interpreted as meaning only instances in which an official was making “discretionary choices” about whether to give the group money, rather than instances in which the transfer of funds to Acorn was required to satisfy existing contractual obligations.

Since there are two possible ways to construe the term “provided to,” Mr. Barron wrote, it makes sense to pick the interpretation that allows the government to avoid breaching contracts.

Moreover, he argued, requiring the government to abrogate existing contracts with a specifically named entity — “including even in cases where performance has already been completed but payment has not been rendered” — would raise constitutional concerns best avoided by interpreting the law differently.

The Constitution prohibits “bills of attainder” — legislation aimed at punishing specific people or groups. Acorn has filed a lawsuit arguing that the statute banning the government from providing it funds amounts to an unconstitutional bill of attainder.

Founded in Arkansas in 1970, Acorn describes itself as the nation’s largest grass-roots community organizing group. It provides financial services to poor and middle-income families, conducts voter registration drives, and advocates for higher minimum wages and more affordable housing.

No DOJ grants went directly to ACORN, but a handful of grants were awarded either to ACORN affiliates or to other organizations that sub-contracted projects to ACORN.

For example, ACORN received a $20,000 sub-contract to do community outreach on crime prevention in New York. The organization that contracted with ACORN has not released the funds yet, claiming that ACORN submitted reimbursements “outside the scope of the agreement,” including “fringe benefits” for the salaried staffer working on the project.

In another instance the city of Phoenix contracted with the “ACORN Institute” to receive about $9,000 to canvass citizens and raise awareness about a tax credit and a tax assistance program. The city hasn’t paid ACORN yet due to “poor reporting by the ACORN Institute regarding another project not related to DOJ grant funds.” Phoenix is trying to terminate its contract with ACORN.

The DOJ did not audit the funds that went to ACORN or its affiliates, but did conduct an audit of one of the organizations that contracted with an ACORN affiliate. That audit concluded that the organization “did not properly manage the grant and did not adequately monitor some of its 36 sub-grantees, including the [American Institute of Social Justice],” an ACORN affiliate.

Doug Hoffman has posted on his site that the NY-23 congress seat ACORN and the unions did their best to try and sway the results to Obamacare supporter Bill Owens, and the reported results from election night were far from accurate. Hoffman goes on to say:

I was forced to concede after receiving two pieces of grim news – - down 5,335 votes with 93 percent of the vote counted on election night – and barely won my stronghold in Oswego County.
Get every vote counted in NY-23On Election Night, the information we received was far different from what we received this week!

Rest assured, they will not succeed, and I am therefore revoking my statement of concession.

That is why I am writing you today. Recent developments leave me to wonder who is scheming behind closed doors, twisting arms and stealing elections from the voters of NY-23.

I’m sure you are as dismayed as I am to learn of the mischief that took place in Oswego and neighboring counties. We know this would not be the first time for the ACORN faithful to tamper with democracy.

Now it’s time to actually count every legal ballot and I need your help to ensure the people of NY-23 get the Congressman THEY ELECTED. Please donate now to help me ensure every vote is counted!

A recanvassing in the 11-county district shows Owens’ lead has narrowed to 3,026. In Oswego County, I was reported to lead by only 500 votes with 93 percent of the vote counted election night, but inspectors found I actually won by 1,748 votes

Let’s force them keep this recanvassing active! Let’s give this election a chance to end differently!
Oswego County elections officials blame the mistakes on “chaos” in their call-in center that included a phone system foul-up, and on inspectors who read numbers incorrectly when phoning in results. This sounds like a tactic right from the ACORN playbook.

The district’s second biggest voter turnout was in Jefferson County, where I had also benefited from a turnaround since election night, gaining another 700 votes. Owens led by 300 votes on the final election night tally, but after recanvassing, I’m now leading by 424 votes.

Jerry Eaton, the Republican elections commissioner for Jefferson County, said inspectors found a problem in four districts where my vote total was mistakenly entered as zero.

The new vote totals mean the race will be decided by absentee ballots, of which the state Board of Elections distributed about 10,200.

The people of NY-23 deserve to have their ballots counted properly, but we can’t let ACORN or the unions keep that from happening. They have more lawyers and more experience tampering with democracy.
State Board of Elections Communications Director John Conklin said the state sent a letter to the House Clerk last week explaining that no winner had been determined in the 23rd District.

Now it’s time to actually count every legal ballot and I need your help to ensure the people of NY-23 get the Congressman THEY ELECTED. Please donate now to help me ensure every vote is counted!

The lawyer’s hiring, announced this morning shortly after Greg Craig officially resigned the post and hung up on CNN and any other news “organization” that tried to reach him, has its own motive. The motive is an attempt by the White House to deflect any fallout that may arise from an ACORN investigation currently underway in Louisiana, says Rep. Steve King from Iowa. Remember, this coming week we are expecting another ACORN video release from BigGovernment of Hannah Giles and James O’Keefe in Los Angeles. King goes on to say:

“Bob Bauer has a public record of defending Barack Obama’s relationship with ACORN, the congressman told supporters. “Bauer’s hiring appears to be a tactical maneuver to strategically defend the White House exactly one week after Louisiana Attorney General Buddy Caldwell raided ACORN’s national headquarters in New Orleans and seized paper records and computer hard drives that may lead to the White House.”

That the House of Representatives “violated the Constitution” by singling the antipoverty group out for punishment, lawyers for Acorn filed a lawsuit on Thursday that seeks to restore the financing, according to the New York Times.

The lawsuit, filed in United States District Court in Brooklyn, says that the Congressional resolution constitutes a “bill of attainder,” or a legislative determination of guilt without a trial. In the suit, Acorn, which came under fire especially from conservative critics after a series of embarrassing scandals, said it was penalized by Congress “without an investigation” and has been forced to cut programs that counsel struggling homeowners, and to lay off workers.

For example, it said, because of budget cutbacks, a first time homebuyer class in New York that enrolled 100 people in September enrolled only seven people in October, after the Congressional action.

“It’s a classic trial by the Legislature,” said Jules Lobel, a lawyer with the Center for Constitutional Rights, which brought the suit. “They have essentially determined the guilt of the organization and any organization affiliated or allied with it.”

The suit represents the first legal response by Acorn to the Congressional action in September, when the House of Representatives added the financing prohibition to a bill on college lending.

Before the vote, the organization had come under heavy criticism by conservative groups amid allegations of voter registration fraud; critics intensified their attacks after Acorn counselors were videotaped giving mortgage advice to activists posing as a pimp and a prostitute interested in setting up a brothel. The counselors were fired.

The Obama administration has also distanced itself from Acorn, which is short for Association of Community Organizations for Reform Now.

Since 1994, the group has received about $53 million in federal aid.

At the time of the House vote, Acorn said the action would have little impact, since the group receives most of its income from members and other supporters. But in the suit, the group said that many of those supporters had cut off their relationships with Acorn, for fear of being tainted.

In an affidavit attached to the lawsuit, Bertha Lewis, the chief executive of Acorn, said she “underestimated” the effect of the resolution. “It gave the green light for others to terminate our funds as well,” she said. “All of our state and local grants were frozen, as were most of our private foundation funds.”

And several applications made by Acorn for contracts with federal agencies have also been rejected, the suit said, including a $780,000 grant for outreach to poor communities about asthma, and an application to set up public computer centers in five different cities.

The law suit names as defendants Timothy F. Geithner, the treasury secretary; Shaun Donovan, the secretary for Housing and Urban development; and Peter R. Orszag, who, as the director of the Office of Management and Budget, enforced the freeze on financing, the suit alleges.

On Thursday, during consideration of H.R. 3126, legislation to establish a Consumer Financial Protection Agency (CFPA), Democrats on the House Financial Services Committee voted to pass an amendment offered by Rep. Maxine Waters that will make ACORN eligible to play a role in setting regulations for financial institutions. Didn’t hear about this in the news? Neither did I. Didn’t even hear it on the “None-News” station Fox News. Trading Markets provides the rest of the story:

The Waters amendment adds to the CFPA Oversight Board 5 representatives from the fields of “consumer protection, fair lending and civil rights, representatives of depository institutions that primarily serve underserved communities, or representatives of communities that have been significantly impacted by higher-priced mortgages” to join Federal banking regulators in advising the Director on the consistency of proposed regulations, and strategies and policies that the Director should undertake to enforce its rules.

By making representatives of ACORN and other consumer activist organizations eligible to serve on the Oversight Board, the amendment creates a potentially enormous government sanctioned conflict of interest. ACORN-type organizations will have an advisory role on regulating the very financial institutions from which they receive millions of dollars annually in direct corporate contributions and benefit from other financial partnerships and arrangements. These are the same organizations that pressured banks to make subprime mortgage loans and thus bear a major responsibility for the collapse of the housing market.

In light of recent evidence linking ACORN to possible criminal activity, Democrats took an unprecedented step today to give ACORN a potential role alongside bank regulators in overseeing financial institutions. This is contrary to recent actions taken by the Senate and House to block federal funds to ACORN.

A recent inquiry into bank funding of ACORN activities by three House Committees found that institutions that would be regulated by the CFPA have provided millions of dollars to the organization in the form of direct donations, lines of credit, cash, and other assets over the last 15 years. to view the vote.
