<p>Notice how Nadler stumbles when the question is asked should the Fairness Doctrine should be brought back. He says it&#8217;s the &#8220;Government&#8217;s airwaves&#8221; then corrects himself calling it the &#8220;people&#8217;s airwaves&#8221;</p>

			<content:encoded><![CDATA[<p><a href="http://www.judicialwatch.org/news/2009/may/judicial-watch-uncovers-new-fcc-documents-fairness-doctrine-debate" target="_blank">Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today</a> that it has obtained documents from the <a href="http://michellemalkin.com/2009/05/08/fcc-funding-cronyism-of-color/" target="_blank">Federal Communications Commission (FCC) concerning the &#8220;Fairness Doctrine,&#8221; a policy abolished in 1987</a>, and other governmental means to limit free speech in the media. Judicial Watch obtained the documents in response to a December 2008 Freedom of Information Act request. More from JW:<br />

<blockquote><p>While President Obama is on record opposing the return of the Fairness Doctrine, which is viewed by many as an attempt to squelch the free speech of conservatives in the media, these documents show that the FCC is considering alternative proposals that may also regulate free speech in the media under the professed goal of &#8220;diversity.&#8221;</p>
<p>For example, in December 2007, the FCC proposed new &#8220;localism&#8221; measures to force broadcast stations to offer programming more &#8220;responsive to the needs and interests of the communities that they are licensed to serve.&#8221; These proposed measures, highlighted in a document entitled, &#8220;The Report on Broadcast Localism and Notice of Approved Rulemaking,&#8221; included a requirement that broadcasters, &#8220;provide 3 hours per week of locally-produced program,&#8221; and that licensees establish &#8220;permanent advisory boards (including representatives of underserved community segments).&#8221; The FCC noted that these measures would become part of the application renewal process to make sure broadcasters &#8220;meet their responsibilities.&#8221;</p>
<p>Problems with &#8220;localism&#8221; are highlighted in a legal memo written by Kathleen Kirby of the law firm Wiley Rein and submitted to Rosemary Harold, serving as legal counsel to FCC Commissioner Robert McDowell. In the document, which was distributed internally at the FCC, Ms. Kirby advises that the Fairness Doctrine &#8220;would do well to stay dead.&#8221; Ms. Kirby then turns her attention to &#8220;localism,&#8221; advising that such a policy could represent a &#8220;stealth enactment&#8221; of the Fairness Doctrine. Ms. Kirby states: &#8220;Convene permanent advisory boards? Give aggrieved listeners &#8216;more straightforward guidance&#8217; on &#8216;how individuals can directly participate in the license renewal process?&#8217; That sounds mild. But then again, so did the Fairness Doctrine.&#8221;</p>
<p>&#8220;These documents are a useful insight into the internal debates at the FCC about the Fairness Doctrine and its cousin, &#8216;localism,&#8217; said Judicial Watch President Tom Fitton. &#8220;We&#8217;re going to have to keep an eye on this FCC. The last thing our country needs is bureaucrats in the Obama administration stomping on the First Amendment rights of conservatives.&#8221;</p></blockquote>

Watch as Bill Press tried to explain Air America’s failure as “running out of money” but avoids Kelly’s conclusion that failing to get listeners was the cause of the cash drought:</p>
<p><a href="http://www.breitbart.tv/?p=280303" target="_blank">“Where they want it, [liberal radio] succeeds, and where they don’t, it  doesn’t.” That seems clear enough to everyone except Press, who responds by  naming a list of markets where people don’t support libtalkers. He complains  twice</a> about the <a href="http://hotair.com/archives/2009/02/02/obama-radio-crashes-and-burns-in-dc/">death  of libtalking Obama 1260 in DC</a> without mentioning the fact that its ratings  were so low it took a microscope to find its listeners. In fact, Obama 1260  carried the entire list of libtalkers Press names as examples of brilliant  voices silenced by an evil conspiracy of conservative radio station owners, and  the station owner dumped the format because he couldn’t sell their air time to  advertisers.</p>
<p>Second biggest laugh: Press won’t apply the Fairness Doctrine to NPR. He  wants government dictating content to commercial radio stations, but not to  government-subsidized radio stations. <em>Huh?</em></p>
<p>Biggest laugh: Press says he doesn’t want the Fairness Doctrine, but the  “Fair and Balanced Doctrine”. That’s why libtalker marketing needs government  intervention to survive. I’ll stick with the free market, thank you.</p>

Obama’s campaign gave <a href="http://hotair.com/archives/2008/06/25/spokesman-obama-opposes-the-fairness-doctrine/">this definitive statement</a> in June 2008:</p>
<blockquote><p>“Senator Obama does not support re-imposing the Fairness Doctrine on broadcasters,” said press secretary Michael Ortiz in an e-mail to B&amp;C late Wednesday.</p>
<p>“He considers this debate to be a <strong>distraction</strong> from the conversation we should be having about opening up the airwaves and modern communications to as many diverse viewpoints as possible,” said Ortiz.</p></blockquote>
<p><a href="http://campaignspot.nationalreview.com/">Jim Geraghty</a> reminds us, all of Barack Obama’s statements come with an expiration date.  Today, Chris Wallace interviewed David Axelrod and asked him directly about the Fairness Doctrine — and suddenly the White House adviser got <a href="http://www.politico.com/blogs/michaelcalderone/0209/Axelrod_punts_on_fairness_doctrine.html">a lot less definitive</a>:</p>

<p>AXELROD: I’m going to leave that issue to Julius Genachowski, our new head of the FCC, to, and the president, to discuss. So I don’t have an answer for you now.</p></blockquote>
<p>That’s hardly a denial, as Politico’s Michael Calderone notes:</p>
<blockquote><p>Lester Kinsolving, the conservative radio host, has twice asked Robert Gibbs about it in the briefing room, and each time, the press secretary didn’t reveal the administration’s position.</p>
<p>Last week, I reached out to press office staffers in order to find out if the administration’s position is the same as in June, and have not yet received a response.</p>
<p>If Obama’s position on the Fairness Doctrine is the same as during the campaign — and I have no reason to believe it isn’t — stating such clearly would quickly silence a lot of conservative critics who assume the Democratic president is going to try and reinstate the defunct policy. Otherwise, the Fairness Doctrine chatter on the airwaves isn’t likely to die down.</p></blockquote>
