“We are reviewing a list of presidential executive orders and directives to get the job done across a front of issues,” said Rahm Emanuel, the White House chief of staff.

Any president has vast authority to influence policy even without legislation, through executive orders, agency rule-making and administrative fiat. And Mr. Obama’s success this week in pressuring the Senate to confirm 27 nominations by threatening to use his recess appointment power demonstrated that executive authority can also be leveraged to force action by Congress.

Mr. Obama has already decided to create a bipartisan budget commission under his own authority after Congress refused to do so. His administration has signaled that it plans to use its discretion to soften enforcement of the ban on openly gay men and lesbians serving in the military, even as Congress considers repealing the law. And the Environmental Protection Agency is moving forward with possible regulations on heat-trapping gases blamed for climate change, while a bill to cap such emissions languishes in the Senate.

In an effort to demonstrate forward momentum, the White House is also drawing more attention to the sorts of actions taken regularly by cabinet departments without much fanfare. The White House heavily promoted an export initiative announced by Commerce Secretary Gary Locke last week and nearly $1 billion in health care technology grants announced on Friday by Kathleen Sebelius, the health and human services secretary, and Hilda L. Solis, the labor secretary.

White House officials said the increased focus on executive authority reflected a natural evolution from the first year to the second year of any presidency.

“The challenges we had to address in 2009 ensured that the center of action would be in Congress,” said Dan Pfeiffer, the White House communications director. “In 2010, executive actions will also play a key role in advancing the agenda.”

The use of executive authority during times of legislative inertia is hardly new; former Presidents Bill Clinton and George W. Bush turned to such powers at various moments in their presidencies, and Mr. Emanuel was in the thick of carrying out the strategy during his days as a top official in the Clinton White House.

But Mr. Obama has to be careful how he proceeds because he has been critical of both Mr. Clinton’s penchant for expending presidential capital on small-bore initiatives, like school uniforms, and Mr. Bush’s expansive assertions of executive authority, like the secret program of wiretapping without warrants.

Emanuel apologized to Tim Shriver, the CEO of the Special Olympics after the Wall Street Journal reported the fiery Chicagoan privately called a group of liberal activists “f—ing retarded.”

Last August, Emanuel “showed up at a weekly strategy session featuring liberal groups and White House aides,” the Journal’s Peter Wallsten reported lastTuesday.”Some attendees said they were planning to air ads attacking conservative Democrats who were balking at Mr. Obama’s health-care overhaul. ‘F—ing retarded,’ Mr. Emanuel scolded the group, according to several participants. He warned them not to alienate lawmakers whose votes would be needed on health care and other top legislative items.”

“The White House remains committed to addressing the concerns and needs of Americans living with disabilities and recognizes that derogatory remarks demean us all,” a White House official said.

Former Alaska Gov, Sarah Palin, who has a son with Down’s Syndrome, was offended by Emanuel’s reported remark, posting on her Facebook page: “Just as we’d be appalled if any public figure of Rahm’s stature ever used the ‘N-word’ or other such inappropriate language, Rahm’s slur on all God’s children with cognitive and developmental disabilities – and the people who love them – is unacceptable, and it’s heartbreaking.”

On Wednesday, Emanuel met with Shriver; Andrew Imparato, President & CEO, American Association of People with Disabilities; Hannah Jacobs, parent and R-word advocate; Julie Petty, self-advocate and former president of Self Advocates Becoming Empowered; and Ricardo Thornton, self-advocate and Special Olympics athlete.

Emanuel said this to an unidentified entertainment reporter (I did not toil too strenuously to ascertain his identity). But said scribe seemed a little bewildered by Emanuel’s assertion, despite the obvious mirth in Rahm’s face as he delivers the line – at the Correspondents’ Dinner. The irony appears to escape the man with the microphone.

Two strange bedfellows have asked Attorney General Eric Holder to investigate President Obama’s right-hand man, chief of staff Rahm Emanuel, for his potential role in the near collapse of mortgage giants Fannie Mae and Freddie Mac.

The letter by Jane Hamsher, founder of the liberal Firedoglake Web site, and Grover Norquist, Americans for Tax Reform Chief, was sent Wednesday, one day before the Treasury Department announced that it will lift the $400 billion financial cap on loans to the government-sponsored enterprises to make sure they stay afloat.

It also arrived just before the Federal Housing Financial Authority announced Thursday that it would place salary caps on 11 of the companies’ top executives.

Since the financial bailout began, Fannie and Freddie have received $111 billion in taxpayer loans. In August, the administration projected the cost for rescuing Fannie and Freddie would total $170 billion.

Treasury Department officials said the cap will be replaced with a flexible formula to ensure the companies can stand behind the billions of dollars in mortgage-backed securities they sell to investors.

“The amendments to these agreements announced today should leave no uncertainty about the Treasury’s commitment to support these firms as they continue to play a vital role in the housing market during the current crisis,” the department said in a statement.

FHFA issued its own ruling Thursday that the base salary for officers besides the CEO, CFO and COO cannot exceed $500,000 a year. That means five officers are exempt and 11 will now face a cap.

The capped executives will be allowed to get up to one-third of their salary in additional incentive bonuses. Any deferred cash salary — like stock salary received by private company executives who received bailouts — will be paid partly as a means to keep executive officers working at the GSEs.

FHFA acting chief Edward DeMarco said the compensation deal is to mimic the one set up by pay czar Kenneth Feinberg for private companies.

“The enterprises must attract and retain the talent needed to accomplish (their) objectives. We have worked with the enterprises’ boards and sought the guidance of the Special Master of TARP Executive Compensation, to develop competitive compensation packages that benefit from the structural standards created for the TARP-assisted firms,” DeMarco said.

Eight of the then-top 11 executives at Fannie Mae left the company just before the U.S. government stepped in with its bailout, as did the four highest paid executives at Freddie
Mac.

Treasury officials will provide an updated estimate for Fannie and Freddie losses when President Obama sends his 2011 budget to Congress in February. The formula Treasury will use will provide the institutions with a sufficient cushion based on the losses they may incur over the next three years.

But Hamsher and Norquist want to know now whether the bailout was in part the result of corrupt practices by Emanuel while he was a board member at Freddie in 2000-2001.

They cited a Chicago Tribune story that described a plan by the executives and the board to use accounting tricks to show shareholders they were reaping massive profits even as they continued down a path of risky investments. The profits were then used to justify the executives’ big bonuses. When Emanuel left the board to enter Congress in 2002, he was qualified for $380,000 in stock and options and $20,000 cash.

In their letter to Holder, Hamsher and Norquist added that the White House has stonewalled any inquiries into Emanuel’s role on the board, noting that the acting inspector general was “stripped of his authority earlier this year by the Justice Department, relying on a loophole in a bill Mr. Emanuel cosponsored and pushed through Congress shortly before he left for the White House.”

The White House has not appointed a new inspector general to determine whether crimes were committed by the board to defraud investors, the two noted, and the statute of limitations for empaneling a grand jury is about to run out.

“Under the influence of Rahm Emanuel, the White House is moving a trillion-dollar slush fund into corruption-riddled companies with no oversight in place. This will allow Fannie and Freddie to continue to purchase more toxic assets from banks, acting as a back-door increase of the TARP without congressional approval,” Hamsher and Norquist wrote.

The two wrote they would like the Justice Department to “begin an investigation into the cause of Fannie and Freddie’s conservatorship, into Rahm Emanuel’s activities on the board of Freddie Mac (including any violations of his fiduciary duties to shareholders), into the decision-making behind the continued vacancy of Fannie and Freddie’s inspector general post, and into potential public corruption by Rahm Emanuel in connection with his time in Congress, in the White House, and on the board of Freddie Mac.”

Asked about the letter on Thursday, White House spokesman Bill Burton did not address the allegations, saying, “I have the feeling that Rahm’s job is very safe.”

D.C. – Following reports that White House Chief of Staff Rahm Emanuel has been orchestrating an effort to intimidate members of Congress and Governors who raise legitimate concerns regarding the effectiveness of the stimulus, House Committee on Oversight and Government Reform Ranking Member Darrell Issa (R-CA) sent a letter to Emanuel saying “While this type of scare tactic may work In Chicago, it will not work to intimidate me or other Members of the United States Congress.”

“I and others have dared to bring these facts to the attention of President Obama, the Congress and the American people,” Issa wrote. “You’ve unfortunately reacted by once again resorting to the playbook of the Chicago political machine.”

Last month, Politico reported that Emanuel had “launched a coordinated effort to jam” Senator Kyl and other Administration critics… “[A]fter seeing Kyl and House Minority Whip Eric Cantor (R-VA) again paint the legislation as a failure on Sunday talk shows, White House chief of staff Rahm Emanuel directed that the letters from the Cabinet secretaries be sent to [Governor] Brewer, according to two administration officials.”

Issa noted, “The fact that the letters were coordinated by you to maximize the level of intimidation is supported by the timing, structure, and content of each letter. Not only were the four letters all sent the day following Senator Kyl’s remarks, but they were also remarkably similar in tone and sentence structure.”

Letter from Ray LaHood, Secretary of Transportation:

On Sunday, Arizona Senator Jon Kyl publicly questioned whether the stimulus is working and stated that he wants to cancel projects that aren’t presently underway. I believe the stimulus has been very effective in creating job opportunities throughout the country. However, if you prefer to forfeit the money we are making available to your state, as Senator Kyl suggests, please let me know [emphasis added].

Letter from Ken Salazar, Secretary of the Interior:

Some key Republican leaders in Congress have publicly questioned whether the American Recovery and Reinvestment Act is working and suggested cancelling all projects that are not currently in progress. I believe they are wrong. The stimulus funds provided through the Recovery Act are a very effective way to create job opportunities throughout the Country. However, if you prefer to forfeit the money we are making available to Arizona, please let me know [emphasis added].

“At what point do you believe your practice of Chicago-style politics violates a public official’s right to speak out in favor of alternative policies,” Issa asks. “The American people have a right to know what role you played in developing the threatening letters to Governor Brewer and whether you intend to continue to engage in these tactics in the future.”

In order to assist the Committee with its investigation of this issue, please provide the following information by close of business on Tuesday, August 11, 2009:

Now onto Rahmbo. Seens a Short Freddie Mac stay made him at least $320,000 according to the Chicago Tribune.

Before its portfolio of bad loans helped trigger the current housing crisis, mortgage giant Freddie Mac was the focus of a major accounting scandal that led to a management shake-up, huge fines and scalding condemnation of passive directors by a top federal regulator.

One of those allegedly asleep-at-the-switch board members was Chicago’s Rahm Emanuel—now chief of staff to President Barack Obama—who made at least $320,000 for a 14-month stint at Freddie Mac that required little effort.

As gatekeeper to Obama, Emanuel now plays a critical role in addressing the nation’s mortgage woes and fulfilling the administration’s pledge to impose responsibility on the financial world.

Emanuel’s Freddie Mac involvement has been a prominent point on his political résumé, and his healthy payday from the firm has been no secret either. What is less known, however, is how little he apparently did for his money and how he benefited from the kind of cozy ties between Washington and Wall Street that have fueled the nation’s current economic mess.

Sources tell me that the Obama team’s review of contacts with Illinois Gov. Rod Blagojevich will show that Rahm Emanuel had only one phone conversation with Blagojevich.

The contact, described as a “pro-forma” courtesy call, came as Emanuel was named Chief of Staff for Obama. Most of the discussion concerned Emanuel’s Congressional seat (which had previously been held by Blagojevich), with only a “passing reference” to the Senate vacancy, according to these sources. No deal for the Senate vacancy was discussed.

However, Emanuel had closer contacts and deeper conversations with Blagojevich’s chief of staff John Harris:

The sources add that the report will show Emanuel also had four phone calls with Blagojevich Chief of Staff John Harris. During those conversations, the Senate seat was discussed. The pros and cons of various candidates were reviewed, and the sources say that Emanuel repeatedly reminded Harris that Blagojevich should focus on the message the pick would send about the governor and his administration.

Sources also confirm that Emanuel made the case for picking Obama confidante Valerie Jarrett during at least one of the conversations. In the course of that conversation, Harris asked if in return for picking Jarrett, “all we get is appreciation, right?” “Right,” Emanuel responded.
